Mental health providers engage with highly confidential health information.  Litigation causes threats to confidentiality that can hinder the therapeutic process, cause potential damage to your client, depending on what you write in the record, and can threaten your practice. This course will provide mental health professionals with a better understanding of legal terms, suggestions for handling requests for confidential information, and guidance with documentation.

This course will award 1 continuing education hour.

  1. Explain what a court order is.
  2. Explain what a subpoena is.
  3. Explain the difference between the court order and the subpoena.
  4. Discuss how to respond to both a court order and a subpoena.
  5. Document client records with a risk-managed perspective.

Ms. Robertson, M.Ed., CAP, LMHC, is a Licensed Mental Health Counselor in Florida and a Licensed Professional Counselor in Georgia. She is credentialed in alcohol and other drug counseling.

Beginning her career in the hospital setting, working in admissions, on the 24-hour unit, inpatient and IOP for both adults and adolescents, she went on to supervise a group of clinicians that went into medical-surgical hospitals to assess and place patients. She went into the outpatient setting, working with adults and families. Throughout her career, Ms. Robertson has focused on training and education through presenting live and authored coursework.
